Allegiance Retail Services, LLC, which sometimes refers to itself as “Allegiance”, “we” or “us” in this Privacy Policy, is a cooperative which provides certain services to its members and to consumers on behalf of its members. For purposes of this Privacy Policy, we refer to the Allegiance members as Member Retailers. The Member Retailers are not affiliates of, managed by, or controlled by Allegiance. The Member Retailers independently own and operate supermarkets, which we refer to as the Member Stores.
Allegiance is committed to respecting your privacy. This Privacy Policy explains our information collection, administration and sharing practices. If you have any requests or questions concerning the information that we collect from you, please contact us at customercare@allegiancehq.com.
Our practices with respect to data collected, shared and used by us, including in connection with this website and each other website which displays a link to this Policy, are governed by this online privacy policy (our “Privacy Policy”) as amended from time to time, and not by the privacy policy in effect at the time the data was collected. In this Privacy Policy, all websites with links to this policy are referred to, collectively, as “our websites” or the “Allegiance websites” and, individually, as an “Allegiance website”. Please review our Privacy Policy regularly, and please refer to the section of this Privacy Policy titled “Third Party Websites, Applications and Functions” for information pertaining to websites which are not our websites.
If you find this Privacy Policy, or any element of this Privacy Policy, to be objectionable, then you should immediately discontinue your use of all Allegiance websites for all purposes.
Information Collected
We, through an independent third party with which we have engaged by contract for this purpose (the “Personal Data Processor”), collect the information which is provided by you when you register on one of our websites, as well as information derived from your use of the services provided by Allegiance, your visits to our websites, your visits to websites which are accessible from an Allegiance website, your purchases from the Member Stores, your Loyalty Club Card application, and your use of your Loyalty Club Card.
We consider your personally identifiable information to consist of your name, mailing address, e-mail address, and telephone number. We consider your Loyalty Club Card number to be personally identifiable information in the possession of Allegiance, the Personal Data Processor, or a Member Retailer, but we do not consider your Loyalty Club Card number to be personally identifiable information in the possession of a third party with which it has been shared in de-identified form.
Allegiance does not collect, hold or have access to financial information, including payment card information that you provide in connection with the purchase of merchandise or services from the Member Stores, or any other information which falls under the generally accepted definition of sensitive information.
We may collect additional information in connection with your participation in any promotional programs offered by Allegiance or a Member Retailer, and information you provide when you submit feedback or complete a profile form. We also monitor overall customer traffic patterns and website usage, primarily so that we can improve the products and services offered by Allegiance and the Member Retailers.
Use and Sharing of Your Information
Subject to your right to opt out of Allegiance sharing personally identifiable information with third parties as explained below in the section of this Privacy Policy titled “Communication Preferences, Opting Out, Deletion of Personally Identifiable Information”, the personally identifiable information that we, through the Personal Data Processor, collect from you may be used by, for, or on behalf of Allegiance; its affiliate Foodtown, Inc.; and one or more Member Retailers. We may use the personally identifiable information collected from you to provide and personalize our services, to help us improve our service to you, and to make our communications more relevant. For instance, whenever you buy products using your Loyalty Club Card at a Member Store which accepts your Loyalty Club Card, we can automatically have those products added to your “favorite products” list, which is accessible when you log on to our online grocery shopping service.
We may also use your personally identifiable information to communicate with you. We may use the information that we collect from you, and we may provide that information to an independent third party under contract with Allegiance for marketing purposes, to provide you with special promotional pricing offers and digital coupons which are transmitted to you using your personally identifiable information, but are selected based on your purchase behavior. Allegiance may also, through the Personal Data Processor, provide the personally identifiable information collected from you to a third party in anonymized form for inclusion in a database.
We may also display targeted third party advertisements which are transmitted to you using your personally identifiable information, but are selected on the basis of your purchase behavior. We do not provide any individual personally identifiable information to the advertiser when you view or respond to a targeted ad. Advertisers (including ad service companies) may, however, assume that people who interact with, view, or click targeted ads meet the targeting criteria—for example, women ages 18-24 from a particular geographic area.
Subject to your right to opt out as described below, Allegiance may share personally identifiable information collected by Allegiance through the Personal Data Processor with one or more of its Member Retailers, without the direct or indirect payment by the Member Retailer to Allegiance of any monetary or other valuable consideration. Personally identifiable information shared by Allegiance with one or more of its Member Retailers will be used, handled and shared by each respective recipient Member Retailer in accordance with that Member Retailer’s practices as described in its published privacy policy. The Member Retailer with which your personally identifiable information is shared by Allegiance may use that information to contact you for advertising and marketing purposes, including to provide you with general and particularized promotional pricing offers and digital coupons.
Allegiance does not collect, directly or through the Personal Data Processor, and cannot access, personally identifiable information such as name, mailing address and e-mail address as a result of use by those customers who receive benefits under the Supplemental Nutrition Assistance Program (“SNAP”) of their EBT debit cards for online purchases paid for with SNAP benefits. However, Allegiance does not, and cannot, separately identify, or distinguish between, those customers who may be SNAP beneficiaries and those customers who are not SNAP beneficiaries in collecting (including by the submission of a Club Card application), using and sharing personally identifiable information in the manner described in this Privacy Policy. Allegiance will consider those customers who may be SNAP beneficiaries and who provide their personally identifiable information to Allegiance, including by the submission of a Club Card application, to have “opted in” to the use and sharing by Allegiance of their personally identifiable information, subject to all of the terms and conditions of this Privacy Policy.
Communication Preferences, Opting Out, Deletion of Personally Identifiable Information
Once you have registered to use one of our websites, you will be provided with access to a “Stay Connected” section by clicking on “My Account” in the top frame and scrolling down to “Stay Connected”. You may opt out of us sharing, or instructing the Personal Data Processor to share, your personally identifiable information with any Member Retailer or any independent third party under contract with Allegiance by selecting the “opt out” box on the “Stay Connected” page, on your Club Card application, or by contacting us at customercare@allegiancehq.com. If you do so, then your personally identifiable information, including your e-mail address, will not be shared by, used by, or used on behalf of Allegiance to contact you for advertising and marketing purposes, including to provide you with general or particularized promotional pricing offers or digital offers. . Even if you opt out, you may receive advertising or marketing materials from Allegiance which are not directed to you using your personally identifiable information, such as circulars delivered by Zip Code. You may also receive marketing materials which are directed to you using only your Club Card number or an identifier based on only your Club Card number.
Separately, you may opt out of receiving promotional and marketing e-mails by following the embedded “Unsubscribe” link.
As of the date of this Privacy Policy, Allegiance does not sell or share for other valuable consideration personally identifiable information with any independent third party under contract with Allegiance for that purpose. .
Please note that there may be instances where it may be necessary for us to communicate with you, regardless of whether you have opted out of sharing your personally identifiable information, for administrative or operational reasons relating to our services.
You or your designated authorized agent may submit to Allegiance your request that Allegiance: (i) confirm that we process and access your personally identifiable information; (ii) correct inaccuracies in your personally identifiable information; (iii) provide a copy of your personally identifiable information as in the possession of Allegiance; and (iv) delete from its database information your personally identifiable information, as to all of the foregoing by submitting your clear written instruction to do so to customercare@allegiancehq.com. Allegiance will act upon your instruction as soon as possible after receipt, in all events within forty five days of our receipt of your clear written instruction.
Legal Disclaimer
We reserve the unrestricted right to disclose your personally identifiable information as required by law, as well as when we believe it is necessary to share such information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of terms of use for a website of ours, or as otherwise required by law.
Third Party Websites, Applications and Functions
Certain websites, applications and functions which are embedded in, or accessed by clicking on a hyperlink which appears on, an Allegiance website or an e-mail issued by Allegiance are provided and administered by independent third parties. In addition, certain websites which are owned, operated and administered by independent third parties and are not Allegiance websites offer, make available or facilitate services which, in some fashion, involve Allegiance or the Member Retailers. The personally identifiable information collected by third parties through, or through the access to or use of, their websites, applications and functions is not covered by this Privacy Policy, but will be covered by the respective collectors’ practices and privacy policies, which may differ from ours.
Cookies
“Cookies” are small pieces of information sent by a web server to a web browser, which enables the server to collect information from the browser. We use cookies for a number of purposes, by way of example to enable us to simplify the log-on process for registered users, to help ensure the security and authenticity of registered users, to provide the mechanisms for online shopping and to enable traffic monitoring.
We use both session ID cookies and persistent cookies. We use session ID cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time, unless you remove the cookie in the manner determined by your particular Internet browser. Disabling the cookie function for your Internet browser will restrict the online services you can use at one of our websites.
Clear Gifs (Web Beacons)
We use clear gifs on our websites from Google Analytics and other third party vendors. This enables us to gauge the effectiveness of our services and marketing programs.
Security
When you enter sensitive information (such as a credit card number) on one of our order forms, that information is encrypted using secure socket layer technology (SSL), and is immediately re-encrypted prior to storage by the payment card transaction processor. Financial information, including payment card numbers, is never collected or held by, or accessible to, Allegiance.
Generally accepted industry standards are applied to protect the personally identifiable information that we, through the Personal Data Processor, collect. While every effort is made to use commercially acceptable means to protect your personal information, its security cannot be guaranteed.
